13 is ordinance to amend the development agreement between the city and the treasure island community development llc for the treasure island project and amend the financing plan and to make the appropriate findings. item 14, this item is a resolution to approve an amended restated disposition and development agreement between the treasure island development authority and the treasure island community development llc for certain real property located on treasure island and yerba buena island and include changes to the attached financing plan and make the appropriate findings. 15 is ordinance to amend the planning code special use district sud to update the treasure island bulk massing figure to make the process for amendments to the design for development document more flexible and to provide for additional circumstances that may authorize the miner modification to the standards in the sud and the

design for development to revise the zoning map to change height district in treasure island to provide for 5 additional feet in certain areas and to remove the special height district designation from 2 easements adjacent to buildings 2 and 3 to make the appropriate findings. item 16, the resolution endorses the joint aspirational statement of the public non profit and private entities known as the treasure island development authority tida, one treasure island, oti and treasure island community development, the ticd. >> supervisor dorsey. >> thank you. in advance of my brief remarks i want to express gratitude to budget chair chan for her thorough review of these budget items and for her contribution making sure we keep the treasure island project on track and making sure we keep everything fiscal prudent as well.

thank you president peskin for wise council and support. thanks to supervisor melgar now enduring the set of remarks i made in the last 8 days about treasure island. the items before you today are sponsored by mayor breed and myself and our hope is these keep the treasure island project on track with a number of amendments. the items insure the project momentum continues in the next major development stage and we deliver more affordable housing, behavioral health building and prepare for additional 13 units of housing. when complete, treasure island will be 27 percent affordable with high quality public realm that offer parks and open spaces, waterfront access and amenities, worthy of our world class city. treasure island is home to resilliant community of 2 thousand resident a majority are low income and members of

the recovery reentry communities making the most of second chances and many cases doing gods wurks to help others. treasure island will hold a special place in my heart. residents of treasure island have been waiting patiently, some more then 20 years for new units and new infrastructure slower to come online then many expected so with these changes we can full full our obigation tuesday the master developmenter and the broad vision, but make good on promises long made to current residents. i want to thank the city staff and external partners who have been so diligent working on this [indiscernible] from development team oewd. staff from controller wagoner office and city administrator chui office. tida staff, bob beck, [indiscernible] ann maria rogers. shery williams and are [indiscernible] who i honored at the board.

our development partner treasure island development corporation and labor partners the building trades and nor cal carpenter union. thank you to chair chan for the support of budget amendments. i hope to have your support and think because we are going through the next ones i want to offer separate thank you and provide contened for the land use item. i sometimes mention many treasure island resident are too long treatedads san francisco after thought or second class san franciscans and not a full san francisco neighborhood. introducing the resolution i wanted to express this board's recognition for the hard work that went into creating the island aspirational statement and also put on the record supporting this vision for a neighborhood that is every bit as much as san francisco neighborhood. in planning for the development successful inclusive mixed income community, tida, ticd and one treasure island contracted with the

initial of mixed income communities to create plans that foster thriving diverse mixed income communities, through working group of stakeholders and community outreach, statement was created identifying shared values of inclusion and excuty, sustainability connection. these are not only treasure island but san francisco values. i'm excited about this work especially intersection with our ambishing endeavor to facilitate production of 82 thousand housing units. this aspirational statement san francisco values at best and recognize the promise the vision that treasure island well represents. final shout out to one treasure island and sherry and [indiscernible] look forward to many partners work we partner with and colleagues i hope i earn your support on this. >> thank you supervisor dorsey. president peskin. >> thank you chair walton. i want to acknowledge the words of supervisor dorsey and the work

of the budget finance committee under the leadership of chair chan. i say as a member of the capital plan planning committee, we are very close to reaching the ceiling of our capacity to issue certificates of participation, which is a funding strategy that the city uses particularly in fiscally tough times to fund all manners of capital improvement, hva c, street repaibing, you name it. while i support what we are doing today, i want to do it with the very clear acknowledgment that we will only subsequentially vote to issue certificates of participation if and only if there is sufficient cop capacity that does not compromise the rest of our capital plan efforts and that was discussed at committee

and this would not be a substantive amendment, it is direction for the board for future cop sales that the resolution that item 14 at page 5 line 17 would benefit from the following whereas, the revised treasure island yerba buena island financing plan provides that the treasure island stage 2 alternative financing will be issued as certificates of participation that will be structured in no less then three separate traunchs with no more then one traunch issued per fiscal year. the sirty issue the first traunch of certificate of participation and subsquents only after the 10 year city capital plan updated after demonstrate capacity for and incorporator the stage 2 alternative financing in the cop plan. each package submitsed and subject to approval for traunch of certificates of

participation would demonstrate compliance with 10.62 of the city administrative code and the city will structure the certificate of participation so lease payments will not be appropriated from the city general fund in fiscal year 25 or fiscal year 26. in other words, we don't have to start paying the interest for three more years. these amendments are acceptable to the treasure island development authority and office of economic workforce development and will provide clear guidance to this board on future cop issuances. >> we have a motion to amend item 14 made by president peskin. do we have a second? seconded by supervisor chan. supervisor chan. >> thank you. i also just want to make clear we have made the amendments in the budget committee. the difference is the amendments was included in the financial plan it self instead of the resolution, so i want to

17? >> item 17, ordinance amending the campaign and governmental conduct code to update and clarify the conflict of interest code's form 700 (statement of economic interests) filing requirements for “proposition q filers” (departmental purchaser initiators and approvers); add the children and families first commission and the enhanced infrastructure financing district public financing authority no. 1 to the list of filers who file with the ethics commission; and make non-substantive corrections to the conflict of interest code sections for the department of public works and the public utilities commission. >> seeing no names on the roster, we'll take item 17, same house, same call, the ordinance is passed first reading. next item, please . >> item 18, ordinance amending the public works code to streamline the enforcement of vending requirements and restrictions, clarify vending permit application and compliance requirements, require certain vending permittees to register with the tax collector and pay related fees, prohibit stationary

ordinance. supervisors chan, melgar, ronan, safai, preston and walton. by way of background, there is a long history with general obligation bond pass-throughs from landlords to tenants and mind you, this is only one of a pass-throughs, these are not capital improvement pass-throughs. these are not utilities pass-throughs, these are specifically pass-throughs around general obligation bonds and by way of backgrounds, some 22 or 3 years ago, there was a solmonic compromise that both landlords and tenants should pay for the cost of general obligation bounds the voters vote for by 2/3 majority to do everything from

paving our streets to refurbering our fire station and police station and general hospital. thank you to the voters of san francisco to provide $300 mill dwrn for affordable housing in san francisco. a few years after that work that was done by then supervisor tom amiano in 2005, 2006, the city and county of san francisco adopted a policy wherein, we have not for the last all most 20 years asked the voters when they vote for general obligation bonds to raise the property tax rate. in other words, we have been retiring as much debt as we have been issuing new debts. it is a self-imposed constraints, which some get upset about because we are not able to issue bonds as large as we would like, but it allowed us

not to raise property taxes when you vote for a general obligation bonds. however, the pass-throughs continued to go up, and in 2018, this was brought to my attention by organizations representing tenant interests and i actually went to the controller and said, how could this be? if property tax rates are not going out, how can pass-through out and then controller ben rosenfield it didn't make sense but it was true. we had the sea wall on the ballot and made a last minute change to allow for hardships but that didn't deal with there general population of hundreds of thousands of tenants. as a result, when we were at this board of supervisors contemplating the affordable housing bond, i promised to solve it once and for all, that

is this legislation and it does not change that solmonic concept of 50/50, but does change the way it is calculated and it is based on the tenant base year, so if there is no increase in the property tax rate from the tenant base year to after a general obligation bond is passed there is no increase to pass to the 10 want tenant and with that is in the recalculation rate. these changes take effect july 1, 2024. in discussion with the san francisco apartment association, wherein, i will correctly represent that we have by no way reached agreement on all things, i was impressed around an issue that particularly effect smaller landlords,

not the large corporate landlords that mostly use the pass-throughs, the veritas of the world and to that end, we agreed in negotiation yesterday we would strike the requirement that-this is really on behalf of smaller landlords, that these pass-through calculations be filed with the rent board. they would still-landlord still has to show how to the calculation is done and present that to the tenant as required under section 37 .3 of the administrative code but page 8, lines 22 and 23 strike the words, file copies of the completed forms with the board and i think that gives a modicum of relief to small landlords, less paperwork to comply with, so i rise to make that motion and thank you colleagues for something i think is matter of fundamental fairness

period of 8 long years through thick and thin, covid, unrest, you name it, the san francisco police department under the leadership of chief scott have persevered in adopting all 272 recommendations and with that, it is my pleasure to turn this over to supervisor dorsey. >> thank you president peskin. colleagues, it is my honor to recognize the san francisco police department for reaching an historic milestone in implementation of 21 century police reforms. dh isn't only a testament to this department commitment to highest standard of policing but more significantly, to city enduring aspiration to lead progressive change nation bide wide. the department submitted the 27 responses to the 272 reform recommendations from the united states and california department of justice as part of the participation in the collaborative reform nish

initiative. i want to offer context what the collaborative reform nish initiative is and what this accomplishment means. in 2011 the obama administration department of justice launched collaborative reform initiative for technical assistant intended to offer participating law enforcement agencies of voluntary construct for reform and improve their departments. historically these kinds of endeavors were remedial. court ordered consent degrees generally in response to civil rights litigation when problems with police department reached intolerable levels but president obama invasion among any others from the president task force on 21 century policing is to create a process that wasn't remedial, but aspirational. i was in the san francisco city attorney's office back in 2015 and 2016 and i will remember a number of

issues that motivated then chief of police graig surto advocate to mayor edlee and board of supervisor to take part in the process. san francisco invited the u.s. justice department to examine the sfpd-the result is 431 page report with 272 recommendations for reform. true lato the aserational origin the u.s. justice department wrote in the 2016 report, implementing the recommendations within this report represents the most promising path forward for the department. if the sfpd does so with sustained diligence and in good faith, it will become a model policing agency in this country. the work of leading this change

chief scott recruited to lead sfpd through the most ambitious reform in history. not long after that. a new president donald j trump pulled the plug ending collaboration. there were 16 cities nation wide with law enforcement agencies engaged in cri work, but only only one city, san francisco decided to keep going. urged by activists who included mrs. jones, founder of wealth and disparities enthe black community, san francisco went back to the drawing board with the state department of justice to reinvent a state level cri to continue its voluntary partnership. change isn't easy and change takes time, but thanks to the dedication of sfpd officer and civilian members, under the leadership of chief scott, san francisco is delivering on

21 century police reforms with successful outcomes. these include significant reduction in use of force and officer involved shooting, expanded de-escalation training. 10 day time lines of body worn camera. increase diversity enhiring and recruit to name a few. the benefits are not limited to our police department alone, san francisco work on police reform made it a role-model for reform nation wide and few times in the nation history was a roll model more needed in policing then following the murder of george floyd in may 2020. when dozens of police departments nation wide looked to san francisco police department for reforms to immolate and today sfpd policies are replicateed in dozens of police department 6789 i want to congrat the members of sfpd who worked so

hard to implement 24 reforms including leadership from this board of supervisors who supported this effort over several years. there are too many people to recognize individually right now, but i do want to give special thanks to few folks, lieutenant eric [indiscernible] officer candy hilder, executive director catherine mcguire, jesus nuvaros. [indiscernible] 100 percent of recommendations have been submitted i know this important work will continue. one of it tenants of 21 century police reform the job of sustaining reform is never finished. rather it is continual work to build on progress and continue to earn the trust of the communities you serve. our congratulations submitting the 272 recommendations of the collaborative reform initiative for doing so

with diligence and in good faith and for doing what it takes to become as the u.s. justice department wrote in 2016, a model policing agency in this country. congratulations. [applause] >> congratulations chief scott and your entire team. >> thank you president peskin and thank you supervisor dorsey. so, all the names have been call ed but i do want to recognize these people standing behind me. this is the core team of the cri implementation and there were many others that took part in the work but this team basically has been together for better part of four years,

and nothing about this was simple or easy, but these are the folks that made it happen started with leadership of executive director maguire. [indiscernible] sergeant rivera. i can name all the names but you named them but i just want to say to the public that, these are the people that throughout thick and thin and throughout all the chaos of 2020 and 21 and covid and george floyd after math really pulled things together for us and but they had help, and we have all our members of the department who had a major contsbution that are here, i like them to stand up as well so they can be recognized. please stand. >> our command staff, starting with assistant chief david lazar who is instrumental in the implementation. assistant chief flaherty not here today. deputy chief dan pera. [indiscernible] we have our directors. instrumental enthe use of force implementation. i won't name all the names, but i want to highlight that this is a total team effort from top to bottom and you supervisor dorsey who were a member of this department also contributed to our success so thank you for your work. you were intimately involved in this work as well. [laughter] [applause] i want to end my remarks going through some of what has been accomplished. 272 recommend ations submitted. it isn't just about checking the box and completing the recommendation, it

is really about impacting the work we do and making this department better, better servants of it city and that is what reform is all about and cri is about. some outcomes to highlight, we reduced use of force by 65 percent from 2016 to-22 and based on recommendations from one of the academic partners, we changed the use of force policy again, the threshold and use of force increased because of the lower threshold, it is starting to come down again. that's a example of what this initiative is about. it is about being able to quickly adapt when things require that you adapt. it is about being flexible. it isn't about perfection. it is about the pursuit of being a better department at all times that lead to diversity in hiring and recruitment, black asian hispanic and american indian recruits entering the academy increase from 52 percent in 2016, to 81 percent-sorry-yeah,

81 percent in 2023. i thought that was a typo for a second. reduction in officer involved shootings to 7 years, preceding the cri and 7 years after a 50 percent reduction in officer involved shooting. that isn't just because of the use of force recommendations, but because the members of our department adapted this work. we changed our training. we changed some of our protocols on how we approach critical incidents and as a result, we are better departments and our outcomes are much better. it is about increased transparency. officer involved shooting investigations and the release of videos and town halls is one of the most transparents processes in the country and we are very proud that. deescalation is for front with

crisis intervention. increase accountability. transparency. i can go on and on and on, but the bottom line is, the members of this department in conjunction with communities and many of you who really helped to push this work forward from the board to commission to mayor office is the reason that we have gotten to where we are. but i will end this, this work is not finished. we still is to sustain the work, still have to continue to improve our processes. we have a 30 by 30 initiative to increase the hiring of women and further increase our diversity in the department, so we are not done. this is great milestone and very happy what we have done, but we are not satisfied and that is what this department is and very proud of the people standing behind me and very proud of the entire department. thank you. >> thank you chief.

>> our next special order commendation is presented by supervisor chan. >> thank you. colleagues today i like to invite self-help for the elderly economic development team to join us and to be recognized for their work. ceefer hue, injurey jerry lee and marking. help community members with job search providing job and career training particularly for the mono lingual community members. through that time, they also identified that chinese speaking and mono lingual small business especially navigating challenges such as language barriers, technology and business marketing knowledge, self-help for the elderly team, this team the employment training and economic development team step up and adopted their outreach and technical assistance to connect with small businesses providing them

with up to date small business resources, community information and assistance in grants and loan applications to make sure that they could access all that is available to them from the city. especially during the pandemic. these team we are recognizing today created very different but really creative culturally competent support to strengthen our commercial corridors including in the richmond and the work they have done with the small business up lift or local economy. i want to say, this team you see they don't just sit at their desk to do the work, they go on the streets and talk to people in person. that is the reason why they face challenges and elements anyone can face when they do outreach on our streets. we know that especially for outreach workers who also have been essential workers during the pandemic.

i'm grateful for them. they encounter many people many challenges, sometimes even situation that put them into potential threats and physical assault, yet this team still go out there day in and day out. they face people still with compassion. still with thoughtfulness in their responses, even including in threatening and emergency situations. their response is still compassionate to the people and to the community and for that i just really want to recognize their work and how grateful i am to them for not giving up. even though when there are challenges every day, so-there is more then you. if you will introduce yourself and say your name and again want to thank you for being here, thank you so much for all the work you do for us.

permitting and marketing and consulting. the pandemic hit all of us, while many place was working with--conducted door to door outreach in chinatown and sunset every day to provide assistance to small business owners helping in grants and loan applications and during the pandemic, our team reach out to more then 300 api small business and assisted with more then--after the pandemic we continued door to door outreach and listen what the merchants needs and create marketing campaign to strengthen the commercial corridor and again, this honor is not only for our team, it is acknowledgment for all the outreach worker and we will continue work with the community. thank you. >> our next special order commendation is presented by supervisor engardio. >> colleagues today we honor members from our police department marine unit, the san francisco bar pilots and u.s. coastguard. come on up everyone. [applause] this group we see save the lives of four people on april 14. what began as a routine morning turned into race against time when a 30 foot boat capsized several miles off the

coast from ocean beach. four people were holding on to the capsized boat in rough water. the bar pilot vessel named the california first arrived on the scene. for those who don't know what a bar pilot is, they are specially trained mariners who navigate ships through the bay and port. rescued two capsized boats and the sfpd marine unit arrivalped to rescue the other two. the u.s. coast guard assisted and fire department assisted staged at the great highway. there are photos from the rescue. this coordinated effort is a example of things that work in our city. all four boaters survived without injury. perhaps the most surprising part of the story is that our police department was involved in a ocean rescue. many san franciscans do not realize in addition to protecting residents on land, our police department also protects residents on the water that surround our peninsula city.

the sfpd marine units responds to water emergencies, it also works to educate boaters and insure they are equip with necessary safety questions and knowledge of conditions so thank you to everyone involved in the rescue and many others. we are grateful for your service. transit can be traced back to his father, michael, who immigrated from hong kong to san francisco and moved to an apartment at leavenworth and washington and was a regular muni rider. many years later, jason's father moved to a suburden part of san jose to be close to his job. there was not much transit and one day was jason was 6 years old, his dad misplaced his car keys. jason and his father had to walk over a mile to catch a bus and the 6 year old jason at that time discovered there was a different way to get around and as i understand it from that first ride, jason was hooks on public transportation literally that misplaced car key by his father inspired a life of commitment to public transportation.

i met jason at a stop in coal valley. don't know if he remembers and i learned about his passion for public transit. jason similar to many san franciscans, particularly many of my constituents does not own a car and primarily relies on transit and walking to get around san francisco. what i immediately noticed about jason was that he had an inpsychopedic knowledge of public transit. not just our munim here, but seamingly every public transit system in cities across the nation and he delighted in sharing his knowledge, even with a total straisker he met at a bus stop. every conversation with jason in the years since, most occurring on buses or trains here in the city, has reflected that same desire to share his knowledge of transit so i as a policy

maker and frankly, whoever was nearby in ear shot could better work for a visionary, well functioning, fast, affordable, comprehensive and ever improving public transportation system in our transit first city. jason held numerous roles during 16 year tenure at mta. many may not know him because his work is behind the scenes and out of public view, even though the public experiences the benefits of his work every day if they ride muni. as program manager for the sfmta customer information system, jason revamped muni real time information to make navigating by transit easier, especially for seniors, people with disabilities, and non glish speakers as well as new riders. hundreds of thousands of muni

riders use the system daily and his work helped them know when their buses and trains arrive, help plan their trips and keep informed of service chaesks changes. driven by outreach effort jaishen and team installed over 800 state of the art digital signs at bus stops and rail stations throughout san francisco that show live vehicle positions, display graphics and text in multiple language and provide audible information for riders. under his leader mta improved prediction accuracy by at least 10 percent. as mta performance manager, jason built a team that created analytical and visualization tools to help meet strategic plan goals. this improved mta transit service planning operational decision making and organizational policy. jason also launched the nation first multimodal all door boarding

policy here in san francisco, a ground-breaking initiative that significantly improved the transit experience for our community. this allows people to board any door of muni vehicles rather then having to file through the front as with the case for generations. this invasion makeed munier more relyable and optimize resources. finally, jason supervisors the sf fellow program, something very proud of since 20 # o8 mentor college grad wailts pursuing careers in local governments his fellows have pursued graduate studies and careers in urban planning and transit and to give back to their communities in so many other ways. starting april 29, jason will be working at the metropolitan transportation commission, mtc as the assistant director for transit initiative program implementation. last year mtc started a new

regional network management group to help unify the customer experience for the region 27 transit operators, including the sfmta bart, golden gate transit, ac transit and sam trans all serve san francisco. jason and his team will be responsible for implementing customer frndly improvements, such as consistent mapping and way finding, service and schedule coordination and enhanced regional accessibility for people with disabilities. jason, i'm deeply grateful for all of your contributions and wish you the best in your new role at mtc and i'm disappointed we will no longer have you at sfmta, excited to work with you in you role at mtc and sure we will continue to see each other on muni and can't thank you enough for your

provide 16 foot vaulted ceiling and attic storage. this add is out of the scale with massing of queen ann caught ottage and oppose bide the vast majority of sth neighborhood. this highlights all the neighbors that submitted support for this appeal. the sponsor chose to improperly boot strap the adu to their plan to add vaulted ceilings and from the very beginning of the process the sponsored argued this tall roof was necessary to be compatible with their historic home yet now the sponsor changed course arguing the planning department made a determination that the 1905 queen ann cottage is not a historic resource. the planning department on the other hand, says that's not true and admits they never conducted an evaluation of

whether the cottage is a historic resource. planning says determination of whether the cottage is historic was not necessary because the project will not be visible from the public right of way. that is false. as you can see from this photo, the addition will tower over the existing home and clearly visible from harper street. the planning department complete lack of analysis is a procedural error and contrary to the city to the historic preservation rules. the 1905 queen ann cottage is a category b historic resource and pursuant to preservation bulletin 16, any age eligible property proposed for major alteration requires a determination whether the structure qualifies of historic resource. the addition certainly qualifies as a major alteration yet planning response to this appeal admits it failed

to make that determination. the fundamental purns of ceqa is to inform the government and public about the rational for the government's approval of a project. here the project sponsors do not know planning's rational and arguing that the planning department made a determination that planning admits never happened. planning did not make a historic determination and stated rational for not making it was the addition will not be visible which is clearly wrong. san francisco victorian era style contact statements states that the gable roof form and massing of queen ann cottage are important character defining features. planning would normally require such additions to not be visible or if they are visible that the addition be differentiated and subordinant to the existing building. here, the addition towers over

the facade and mimic design. i lick to introduce historic preservation architect to explain the flaws in the analysis that took place and why the proposed addition does not meet the secretary of interior standards for rehab of historic buildings. >> good afternoon. mike. president peskin and supervisors. i am president of architecture, 38 year old preservation planning architectural firm in san francisco. we have been engaged to discuss review processes applicable to the project at 72 harper and studies the documents and using my experience i have a few observation i'm trying to understand. first, it is claimed the building isn't a historic resource, but historic resource determination was not completed identify 4 projects

handled in a similar manner to 72 harper looking . there is formal historic resource determination. there were three formats used which changed over time including a preservation review team form, historic resource determination form and assessment form. each utilized historical research provided for each project resulting in formal determination which were used for project approval. 72 harper provided supplemental information for review, it never received a formal written analysis such as the project referenced in the april 15 letter. this seems omission of documentation. the second concern, it was established the building was not historic resource, why was the standard compliance review considered and again without any written analysis? non historic property does not need to have a standard compliance

review completed as that is reserved for historic properties usually under ceqa review. being it was assumed it wasn't historic why would a compliance review be completed at all? there is no formal documentation to justify the lack of impact to character defining features. it is commonly expected when completing a standard compliance review a written analysis be provided typically addressing applicable complinets with standards 1-10. third concern for standard complying project a common requirement limits addition to the height of the existing building. standard compliance reviews in san francisco often limit an addition to the height of the building and this is done to avoid impact to the character defining form. fourth concern as been stated, the building is clearly visible from harper street. you saw the image earlier.

the addition was-i did this sketch just for simplicity and clarification. the little white addition is placed directly over the dormer that will be demolished and it is clearly visible as an addition. the massing of queen ann cottage include a simple gable roof sometimes with dormers. very common queen ann type form in san francisco. the project adds oorthd roof addition on top of the cottage and and over wellm the design. happy to answer any questions as we move forward. thank you. >> in short, planning admits it did not conduct analysis required under ceqa. the project sponsor said they needed the over-sized roof because it is historic building and say they are allowed to have the over-sized roof because it isn't historic building and the planning department doesn't know if

it is historic or not because it failed to complete the historic analysis required by law. ceqa was clearly violated. but the solution is also clear. use a flat roof at the existing height. a flat roof would comply with ceqa, would reduce neighborhood impacts and cause no reduction in habitable space for the sponsors. we urge the board to grant the appeal and direct the planning department to require a flat roof alternative and should also direct the planning to process and approve the adu separately as required by law. thank you. >> that conclude your 10 minutes? >> yes. >> okay. we will now go to speakers on behalf of the appellate not to exceed 2 minutes per speaker.

seeing none, going once, going twice, this public comment on behalf of the appellate is closed. we will go to the planning department not to exceed 10 minutes. mr. sucray. >> good afternoon president peskin and members of the board. i'm rich, deputy director of the planning division and historic preservation team lead. joined today with our environmental review officer lisa gibson, our deputy environmental review officer debbie jean as well as other planning staff members. the department issued a class 1 categorical exemption for existing facilities for the project in december of 2023 following a preservation environmental review process by department staff and determined no further review was required. the project was subsequentially heard at the planning commission discretionary review hearing february 2024 where department staff

maintained the project was code compliant and met the residential design guidelines and preservation criteria. overall the planning commission concured with staff findings, supportive of the project design and ultimately did not take discretionary review in a unanimous vote of 6-0. staff maintained the project is code compliant and respectfully recommend the board uphold the department determination. the projict is a alteration to existing single family residents that includes conversion of existing unoccupied basement to accessory dwelling unit and construction of 3 story rear addition to maximum height of 30 feet. in total the project add 1091 net new square feet. the property is desinginatesed as category b building which means the building is more then 45 years old and

no historic resource determination has yet been made for the property. when a project is submitted to the dp apartment for review, the department reviews the scope to determine whether the project complieds with code and what level of environmental review is required which includes historic preservational review. for a project that could effect a historic resource, we further evaluate the proposal to determine whether it could materially impair character defining features that contribute to the building overall historic nature. the department undertakes reasonable approach in the review process by relying on city wide contact statements, previous studies of similar project and staff expertise on technical subjects matter. as such, not every project requires a site specific historic resource evaluation and not all buildings that are classified category b are reclassified as category a, historic resource or c not historic resource. particularly if the project does not

propose changing to potential character defining features. for the purpose of historic preservation and ceqa the environment evaluated is visible or accessible by the public. the environment is that visible from the public right of way. department staff consider potential impact to those portions of the building visible from the street and sidewalk. next slide. from public visible area the scope is limited to modest alteration to the front steps and construction of one story vertical addition with gable roof set back 19 feet 5 inches from the front building wall. the department found the proposed work would not remove potential character defining features and new elements compatible with the existing building. character defining features of the project site were identified and based upon the adopted victorian era files contact statement. more specifically staff evaluated the project impact on potential character defining features that were

determined the scope did not alter visible features associated with the 1905 building, inclutding the gable roof, wood windows, wood ornamentation and mix of siding. since the project would not impact the features, the proposed work could be removed and neither historic resource evaluation nor reclassification from xat gore b was necessary. the applicant have not presented information to support the assertion the project has adverse impact on any potential character defining features there is a impact to historical resource. the applicant have not provided substantial evidence to make a fair argument the proposed project is result in the inability of a potential historic district to express the historical presence because the proposed addition does not remove or alter the features associated with a potential district.

if the formation of such district were to occur, previous evaluations of the properties and vicinity have not identified a potential district. thus it is fair to say and conclude the department appropriately determined the projbect would not materially impair the subject property or surrounding area. with the preservation analysis in mind the department determined the project is eligible for class one categorical exemption. class 1 exemptions allow up to 10 thousand square feet of new construction to be added and the proposed project adds 1100 net square feet, 11 percent of the allowable areas allowed. none of the exceptions that preclude the project from eligibility under a categorical exemption would apply. we want to review acknowledge of the information sent to us.

upon review of the information it doesn't conclude or change any of the previous determinations by department staff. next slide. for these reasons and those described in the appeal, the planning department recommend the board uphold the departmentation the project is eligible for class 1 categorical exemption and reject the appeal. this concludes our presentation and department staff are available for any questions. thank you. >> thank you. i have couple question for you. the first is one i asked the first time we talked about this and every since, this appeal feels inacronistic to me in that this is a appeal of a ceqa determination made in conjunction with discretionary review that was requested at the planning commission.

provisions prior to that time, so hence why we moved forward with the discretionary review hearing as well why the timeliness for the appeal under ceqa was tied towards the discretionary review item. i think moving forward we are cognisant that discretionary review is still a option for projects that are under the review of planning at that time. typically given recent state laws we have inability to appeal projects that are creating new housing or net new housing, but usually the scope of the work is tied only to the portions directed towards the housing itself, so for example, the adu is not subject to appeal and ministerial in nature, but the vertical addition potentially could be so it is something that the department evaluating on a case by case basis as those projects move forward. we will note an icdotally we

this is typical code compliant project in sf. we are requesting zero variances, zero conditional use authorization. under the central neighborhood large home district ordinance, we are actually allowed up to a 15 percent increase in square footage, we are choosing not to do that and instead keeping the main floor flat. we are including a adu, again for my elderly in-laws. earlier this year, we went to discretionary review as many heard. at that review planning commissioner derek brawn said, "i think the project is in many ways modest relative to what can be allowed under code". the reason is this is a home for my family. we are not looking to maximize square foot age, we are looking to meet family needs and respectful to the neighborhood. you heard earlier that we are raising the gabled roof in the rear of the house. i want to be explicit, the

front facade of the home isn't changing and in fact, the rear gabled roof is a good 20 feet from the front facade. why are we raising the gabled roof? today we dont have any bathrooms on that floor. the middle of the night you want a bathroom on the floor. we are trying to maximize the width of our home and in order to do that, under planning code we need a minimum ceiling height of 7 feet, 6 inches and so that's what we are doing. raising the roof in the rear of the house to allow for that minimum ceiling height of 7 feet 6 inches and that leads to roof increase of 7 foot 3 inches. i do want to point out that under planning code we can actually increase our roof height to 12 feet but we have chosen not to do that out of respect again for our neighbors. at the discretionary review and again today the lawyer asked the planning commission to modify the roof

design. all the requesters are asking today is a vertical flat roof instead of a peeked roof. planning commissioner vice president catherine moore said, a building with a pitched roof really supporting a extending the traditional expression of this building is far more important then devaluing the building with a flat roof. i find it slightly funny that the applicants are saying that they are here to maintain our historic roof line but at the same time requesting a flat roof on a home that already has a gabled roof. here you see the back of the house a rendering with a articulation of the gabled roof. the planning commissionue naninously requested the request and voted to support our project as designed. in their words, looking at what is proposed here it is a lovelybleding. this is a admirable well designed

building. having failed to get their way at planning commission, they are here today asking their lawyer to use ceqa to delay the project and asking you the board of supervisors to require additional studies, the alleged justification, the planning department failed to discuss the projects, this is procedural error and trying to imply we are pulling a fast one. this is false. over a year ago the planning commission issued us a ceqa exemption. we proactively fallowed up and asked them to confirm our project had been properly reviewed. here you note an e-mail from the architect dennis bud dated april 4, 2023 where he asked, can you please confirm within environmental planner to make sure that the categorical exemption check list is correct. this residential project includes addition to cap b resource viewable from the public right of way. the environmental planning commission

actually looked at this, reviewed twice and confirm said our project had been properly reviewed and did not require further studies. here we have a e-mail from don lewis with environmental planning. his response is from the preservation manager persperktive, since the proposed three story addition is set back sufficiently enough, there is no need for the part 1 historic review. why is that the case? as the planning commission mentioned earlier, we are not changing or removing any potential character defining features. we care about the beauty of the home and not changing the front facade. the scope of work does not alter visible features and the rear addition is set back all most a full 20 feet or 19 feet 5 inches to be exact from the front facade. again, we care about the beauty of the home. i think in times like this it

requested and i urge you all to review it. the results so far from this program are nothing short of remarkable, especially given that we launched this program during a global pandemic. i want to share some highlights from the report with you. san francisco emergency renal assistance program known as erap provide said a total of $61.2 million worth of localerantal assistance to 10.110 households from 2021 through march 2024 and still some funds left and applications are still being processed. the program overwhelming benefited the most vulnerable san franciscans preventing thousands of people from becoming homeless during the pandemic and the start of the recovery.

half of the erap recipients were black or latinx. 87 percent of the recipients were extremely low income earning from 0 to 29 percent of ami. the top neighborhood served were tenderloin, soma, bayview, lower polk western addition and mission. colleagues, this report really shows what happens when we tax ultrawealthy corporate interest to fund people basic needs. thajs to this program over 10 thousand households at least 20 thousand san franciscans were spared eviction and crushing debt. i am credbly proud of how our city came together to make this happen. san francisco had by far the largest local rent relief program of

any city and when we launched this effort there were many who said it couldn't be done and some fought it politically and in the courts but our vision was to insure the health crisis did not become an eviction crisis. i believe as i do now evictions should be a last resort not a starting point when people face hardship. with eviction bans, right to counsel and robust local rent relief program we achieve the vision preventing mass displacement, saving homes and saving lives and leaving tenants, landlords and our entire city in a much better place then where we would have been without these crucial measures. i am especially proud of all the voters who voted for prop i, the single biggest source of funds for the erap program laid laid out in detail in this report. also proud of all the community

partners, outreach and intake workers people knew of the program and access funds. all the tenant who tack took action to stay in home jz the board of supervisors that went through bat for the funds through appropriation budget negotiation and implementing legislation. i also like to recognize the hard work of the community development staff at it mayor office of housing community development lead by brian chui who implemented this unprecedented program in a global pan deming with constantly changing rules and landscape of federal and state regulations. i highly recommend colleagues and members of the public everyone review the report on the city website listed with the budget legislative analyst reports. learn more about the impact of our work together on this. it really shows that what we as a city

can do when we tax the ultrarich to provide the help people need. today i am introducing resolution in support of us senate bill 1218, the green new deal for public housing by senator sanders and representative cortez and thank early cosponsors supervisors walton, ronan and president peskin. the federal legislation builds economic empowerment through modernization of public housing emproving the state of public housing increasing the number of units available nation wide. the green new deal for public housing act allow for increase in public housing units, created 280 thousand jobs and invest up to $23 billion a year for 10 years for highly energy efficient developments. passage of this bill which

improve expand public housing for the first time in generations would take us a big step closer to making housing human right in this country, while investing in upgrades with substantial benefits for the environment. i won't go through all the details but i will highlight a few here. the bill specifically does a few things repeal the fair cloth amendment which limit construction of new public housing development something i talked about in the chamber and subject of resolution previously passed. to transform housing we have to scale up public housing, something impossible to do at scale with the current out-dated and racist fair cloth amendment that continued to exist since 1998 in federal law and pleased to see it would be eliminated through passage of this bill.

the senate bill 1218 also insure all public housing is brought up to sanitary sustainable condition with the type of federal investment to deliver on that promise. it provides funding to electify all public housing, add solar panels and secure renewable energy sources. it also would support families and sustainable communities by building new child care and senior centers, expand access to clean transportation and create community gardens and community investment and expand federal programs to provide with expanded work opportunities and finally, last thing i want to highlight in there that is think particularly important is expanding investment in residential council so public housing residents have a seat at it table for important decisions regarding their homes.

her parents were putrina born in new york and leo, born in san francisco. her parents live in nort beach and later moved to mission terrace in excelsior surrounding by 8 aunts and uncles all in a few blocks of each other. pats family was no exceptional. she attended corpus christi school. she was a fanic artist and ran the parish paper. she attended saint vincent high school in saint mary cathedral site where she was 16 year old pat met the love of her life dave at a party. they were married at 19 and spent the next 68 years holding hands. people talk of a love story, pat and dave lived it every day.

pat and dave marriage served as a example of a loving couple for generations to come. dave and pat had 4 children, 3 boys and a girl. her children will tell you how highly organized pat was and her sense of discipline and order kept the family running smoothly. it was a 5 by 7 index card taped near the phone with everyones name, the time they had to bathe, the chores assigned, who had the first choice on the tv and what time they had to go to bedism favorite times were family events hosting dinner parties, sewing and shopping. she and dave enjoyed lifelong friendship and travel. during her life pat found joy in artistic endeavors including oil painting and water color and able to achieve traveling to israel in 2018 with her daughter mary.

children and spouses grand children and great grand children are her main joy in life. survived by children mike, sally, steve, patty, tim, carol and mary and marty. 10 grand children and 8 great grand children. after a wundserful fulfilling life pat pased away march 27. pat will be remembered as a lady with a sharp memory and wisdom who spoke mind without reservation. truly one of a kind reunited with husband dave her spirit remains with family and friends forever. i had the honor attending her memorial last friday and it was a wonderful celebration of her life, a beautiful turn-out and so many family and friends were there to honor her. the second in memoriam is for a

mayor breed. hopeful these new rules provide better clarity and enforcement tools to dpw, sfpd and agencies tackling concerns. unlicensed alcohol vending was authorized. this activity raises serious public safety concerns in terms of alcohol sales to miners and potentially also in terms of resale of stolen merchandise and significant and persistent issue of fairness for local businesses where bear high permitting burden that provide jobs that generate tax revenue and play by the rules. i know i'm a broken record around on police under staffing issues that drive so many of our public safety challenges, while dpw is is a lead enforcement agency, have enforcement authority for alcohol sales but resources are stretched very

29 and i was 26 when we met. mark was a young doctor a couple years out of medical residency. the future looked bright. we were going to a music festival east bay saturday afternoon as we walked in mark felt a sharp pain in his stomach. he stopped and then just doubled over. i helped back to the car. on the way home we were stuck in traffic at the bay bridge, the pain was more intense. mark climbed into the back seat and curled in a ball. we thought maybe his appendix would birs. i drove to the hospital. all the doctors and nurses were shocked to see the colleague in the er and couldn't figure why mark was in so much pain. it wasn't his appendix. showed patches all over his liver. those were tumors. mark was fit always at the gym never drank alcohol so it was a big surprise when mark ended up with advanced liver cancer at age 30.

the first symptom was the extreme pain he felt going to the concert is how sudden it was. a few months later i was driving mark home from chemo therapy and the was a bus in the next lane. we couldn't believe the ad on the bus. the ad warned that 1 in 10 asian americans are infected with hepatitis b and don't know it and could get liver cancer. finally mark illness made sense. the bus ad was sponsored by the asian liver sentser at stanford. mark was a doctor and never heard of the asian liver center. none doctors heard of it either. we made an appoint. then found the asian liver center was just a basement storage room at stanford a tiny office. this was in 2001. it showed how little the medical establishment paid attention to hepatitis b in asian american s back then. we met with the director dr.

samso. on a mission to end epidemic of hepatitis b calling it a silent killer. renowned surgeant yet there he was in the basement. doctor so told it was too late for mark, dr. so also told us mark did not get the information that could have saved his life chronic hepatitis b is passed from murlther to child at birth. for 30 years mark chronic hepatitis b was a ticking time bomb. had known the status could have caught the tumors in time for surgery. it was devastating to hear dr. so tell it was too late for mark but as mark acceptsed his fate we wanted to raise awareness to help others. before mark died he saved lives by telling his story. he was in the san francisco chronicle first report about the threat of hepatitis b. mark wanted people to know
