a school campus, the scene of an attack on a young girl. tonight new information on why a woman might strike a third grader with a hammer. good evening i'm julie haener. >> and i'm frank somerville. a 9-year-old girl is hospitalized after she was attacked with a hammer by a school volunteer. jana katsuyama live now at oakland children's hospital with new information about a possible motive in the case, jana. >> reporter: frank, first of

all i checked with school officials who say the girl is being treated for injuries but they could not go into specific details. i did obtain a copy of the letter they sent out to parents saying they were outraged and they explained to the parents what they knew. the third grade student was outside on the playground around 10:40 this morning. a parent volunteer lured the guile into a near by bath -- the girl into a near by bathroom then the woman assaulted the girl with a hammer. students who were near by said they were scared. >> i just saw the police, they were coming into the boy's bathroom. >> reporter: the alleged attacker is hasima deyame not a stranger but a parent well known on campus who was a frequent volunteer. investigators are still trying to figure out a motive. school officials say it appears the woman did have a connection

with the student's family. >> it may have something to do with rivalries and feuds occur off campus spilling over on- site. >> reporter: school officials were sent home. the child is incredibly resilient and is conscious and communicating despite her ordeal. >> that is very scary. i mean if i was here and i saw a lady with a hammer i would have taken my daughter out right away. >> why would someone come and assault a little girl at school? it makes you afraid to send your child to school because it makes you think it's not safe at school. >> reporter: officials tell me that woman is being held by oakland police on charges of assault with a deadly weapon. and they say she could face additional charges. reporting live in oakland tonight, jana katsuyama, 13 eyewitness news. school officials tell us they plan to have extra staff on the campus on monday morning including counselors for students. the inclusion it was a tragic accident. and the fatal shooting of one

b.a.r.t. police officer by his fellow officer doesn't merit charges. on january 21st, b.a.r.t. police were searching the dublin apartment of a robbery suspect. during the search detective michael may shot and killed thomas smith. the report released concludes there's insufficient evidence to charge mayse. the lay out of the apartment allowed detective smith to circle around and come to the closet. the gun was raised. the gun was not pointed directly at me it was pointing toward me. mays believed the armed figure was a threat when he fired one shot hitting smith in the heart. and at ktvu.com you can read the report for yourself. we have posted it under hot topics right on our home page. the death of a mentally illman who was killed -- mentally ill man has been ruled

accidental. cheng barricaded himself. efforts to talk him out failed. after a six hour stand off a s.w.a.t. team entered the home. investigators say chang stabbed one of the officers in the arm and that's when police fatally shot chang. his family says that chang was schizophrenic. new developments tonight in the case of the los angeles clippers and the teams embattled owner donald sterling. this evening the nba gave at the present timetive approval of the sale by sterling's wife to steve balmer for $2 billion. shelley sterling also agreed not to sue the league. but donald sterling is. he has filed a suit for $1 billion. several reports surfaced about donald sterling's mental health. some of those reports say he is mentally incapacitated. and tmz is reporting that he

was recently diagnosed with alzheimer's disease. happening now the first night of this year's bottle rock music festival is coming to a close in downtown napa. it is the first true test of all the changes since last year's less than successful show. ken pritchett is live in napa with a look at how it's going so far. >> reporter: this is mayor hawtho are -- hawthorn on day one of bottle rock. this event could have been a one hit wonder until new promoters came in to resurrect it. >> everybody told us we were crazy. could you really book bands. could you really get all the

>> reporter: owner of cannabis clubs are offering free or discounted marijuana for their vote. >> we need to make sure that we get somebody in place that's actually going to treat this topic fairly. >> while incentives for votes aren't new, they are sometimes problematic. in 2008, starbucks had to stop a promotion offering free coffee to those who voted when they found out they violated codes. and the registrar says the offer of marijuana presents similar concerns. >> it appears the federal code is stricter than the state code. >> reporter: still those at the cannabis club says the votes for weed already has the desired effects, raising awareness of tuesday's election. >> any time you get people to vote that's great. you have to exercise your right. >> reporter: a list of

participating clubs will be released monday. according to the district attorney's office the promotion may violate the law but no arrests are planned. we're getting a good idea of who's registered to vote next tuesday. a new poll shows a majority of californians 17 million registered voters more than 43% are registered democrats. 23% identify as republican and 21% registered with no party reference. the voter roles have increased by more than 500,000 people from a year ago. and we'll bring you the results as they come in. we'll also be updating twitter, facebook and ktvu.com. crews working on the b.a.r.t. extension to silican valley have dug up human remains.

new at 10:00, a boom in business in the east bay. city officials say at least 78 new businesses have opened up in oakland in the past year. amber lee joins us live now with the advantage of setting up shop in oakland and why not everybody is happy about it, amber. >> reporter: julie we're at district a restaurant and lounge. the owners first opened up in san francisco and then decided to open a second location right here in oakland. in old oakland the bartender at district can serve a wide variety of alcoholic drinks. the liquor license is $25,000. in san francisco the owners can serve only wine and beer. they say an unrestricted liquor

license would have cost them $200,000. so they decided to expand into oakland. >> it's more appealing in a sense that it's less expensive to do business out in oakland than it is in san francisco. >> reporter: the owners of a company supply plan to expand to this 24,000 square foot space in downtown oakland by september. the company moved its 53 employees into oakland last week. it plans to hire 17 more people. we asked the ceo an east bay native why oakland. >> it's a perfect place. proximity to everything. accessibility from b.a.r.t. there's already a great culture here. >> reporter: hodge an oakland native still livers in the west oakland home she lives in. she wrote an article about the concerns about the changes in this city. >> i don't want to say i'm against newness and culture shifting and changing. but what i'm against is people who have no place else to go. being asked to leave, being

suggested that they leave or plain feeling unwelcomed in our own city. >> reporter: the owner of juwho restaurant says she also is concerned. she moved her home from san francisco to oakland. she says all but one of her 14 employees lives in oakland. >> if there's ever going to be a city that's going to gentrity in a way that will not just push out all of the long term residents but unify those two communities together it would be oakland. >> reporter: back here live at district, the owner tells us oakland officials have made it opening a business easier here than san francisco. from attitude to paper work. two san francisco giants fans testified today about the lack of security at dodger stadium when bryan stow was beating on opening day back in 2011. stow is seeking $37 million in

damages from the former owner of the dodgers. that's the estimate of the cost of his lifetime scare due to his traumatic brain injury. they testified that one of the men who admitted to beating stow harassed them as well. a bay area man who survived last week's massacre near ucsb was in court tonight. he's a college student from alamo and he just happened to be visiting a friend in isle of vista when he was deliberately shot. >> it's a time when people are feeling down. i just don't want people to be distracted by that whole side of it that they forget like that people are still alive.

people survived this thing. >> he says he is still in pain but he's happy to be alive. and the rampage is being shunned online. patti lee is live where a group gathered to send a message. >> reporter: the activists filled this plaza here at 25th and mission. they are using the momentum generated by more than 1 million tweets hash tag yes all women to keep that conversation going. protesters spoke out against the hatred that fueled the rantings of elliot rogers. >> i'm sick of it. this is what is going on in our culture. >> hi. >> reporter: rogers declared his desire to kill as many women as possible. because they rejected him. that sent the twitter verse

there was a rally here today. there will be four other rallies across the country later this weekend. patti lee, ktvu. firefighters made quick work of a grass fire burning in the north bay. the fire started along oak springs drive in napa county near the solano county border around 2:00. there are homes in the area but no one ended up being evacuated. calfire today announced it is suspending open burning permits for several counties because of the hot and dry conditions. starting this sunday june 1st, open burning permits will be suspended for napa, solano and calusa lake and yolo counties throughout california. kaiser's newest hospital is set to open its doors in the east bay. the complex is located off marina boulevard in san leandro. the hospital which has 264 beds

and 116 offices will replace kaiser's aging facility in hayward. it is scheduled to start taking in patients on tuesday. a bit cooler today across the entire bay area. temperatures down 10 to 15 degrees from yesterday's highs. look at just the 50s in pacifica and san francisco. warmers locations in the 70s and 80s. right now looking out toward the bay bridge, we just have a solid deck of clouds. not that dense fog but basically the marine layer kind of expanding in depth. as a result we're seeing more clouds pushing in across the bay. here's the latest on the satellite the clouds offshore but also pushing into san francisco. hayward right now reporting mostly cloudy skies. lots of overcast out toward san m ateo and south san francisco. as far as the forecast for tomorrow morning. partly to mostly cloudy conditions. drizzle possible, coast side and right around the bay and temperatures to start out your saturday morning will be in the upper 40s to the low to mid-

a fifth grader gets off his bus with a scratched face and bruised ear and it didn't come from a fight with another child. >> he said i was attacked by and he used the students name. and said so and so's father. i was attacked. >> reporter: and now that father is under arrest and facing a felony charge. but it's not just the father who's in trouble here. rob roth tells us why the bus

driver is also being investigatedded. >> reporter: as school is about to begin here at wilson elementary yesterday morning a fifth grader who looked like he had been crying approached the principal. >> his words to me was i was attacked by a dad. >> reporter: authorities say yesterday morning a father followed his second grade son on to a school bus for special needs students. he first began shouting then the man grabbed kelvin davis who was sitting in his seat. this is the picture the boy's guardian sent us it shows a cut on the cheek and a swollen ear. police then arrest bernice hurd. he was drink, he was upset about an incident.

the driver simply droppedded the students off at school and drove off. >> i would have preferred that the bus driver escorted the student into the office and let me know exactly what had occurred. >> reporter: we've been told the driver has been reassigned but he is still operating a school bus. the school district is reviewing procedures. >> i don't believe from what i've heard this was an appropriate response by the individuals working at the bus company. >> reporter: that bus company called first student did not return our calls. as for the 11-year-old his guardian tells us she's worried that what happened to him could trigger nightmares. rob roth, ktvu news. students, teachers and parents stood outside of bishop odoud school in protest. the group is upset about teachers being forced to sign a morality clause to keep their job. now it appears the diocese may

his encounter with a car. it's evidence of a growing trend. more and more wildcats even mountain lions are leaving the hills behind and heading toward residential areas. >> reporter: two bob cats were hit by cars in the east bay in just the last couple of weeks. one of them did not survive. the other is now recovering here at this wildlife facility in san jose. >> he's approximately 20 pounds and he's an adult male. >> reporter: this bob cat was found with its right rear leg fractures after being hit by a car in the outskirts of fremont last week. >> it was touch and go for the first few days for not only did he have a fracture but he had possible spinal trauma as well as severe head trauma. >> reporter: workers say they are seeing a trend of more wildcats coming closer to

civilization. >> there's definitely been a spike in predatory sightings. >> reporter: rehabilitation services say this is the third bob cat they've been talked about. some years they didn't see any bob cats in the center. in just this month they were able to release one of them back into the wild. >> it definitely relates to the drought. so we think. but it's going to be really hard to determine that this year. >> reporter: she says biologists are also looking at other possible reasons in the spike in calls about wildcats including human encroachment and mating patterns. as for this guy, they say when he's a little better they'll move him to an outdoor enclosure. make sure he can hunt and feed himself then release him back into the wild. cara liu. >> reporter: ktvu was in mountain view earlier this month when crews cornered a mountain lion. it had wandered into the parking lot of an apartment

complex. the animal was safely captured and released back into the wild. we then learned the big cat had just left his mother to find his own territory. two construction work fell about 100 feet from a crane. they were working in yolo county north of vacaville. cal osha say the men were in a basket that was being hoisted up at the start of the workday. it appears a hook broke and the men fell toll the ground. the father of one of them also worked with that same construction crew. they were all from disney construction based out of burlingame. new developments in an accident we first told you about early yesterday morning. the driver is suspected of running over a 60-year-old man is being charged with two felony duis and resisting arrest. the victim had been loitering at the station and at one point either layed down or fell down behind the car.

the passenger told a station agent to call 911. when firefighters arrived the driver 32-year-old lam of san francisco then allegedly backed up and ran over the man twice. a pleasanton teenager was sentenced today to nine years after a crash last year that killed a bicyclists. the sentencing was part of a plea deal for cody hall. hall was going more than 80- miles-an-hour in a 40-mile an hour zone when he hit and killed 58-year-old diana forholtz. one of his posts read drive fast, live young. he apologized today to the victim's family. a billionaire investor and high stakes las vegas gambler are all tied into an

investigation of possible insider trading. federal investigators want to know if carl icon shared information that he may have had about clorox which is based in oakland. icon was mounting a take over bid of clorox when those trades were made. wall street managed to set a new record in an otherwise lackluster day in trading. the embattled head of the veteran's affairs department said today he is stepping down. jaquelin fell has been following this story. she was there as eric shinseki apologized. >> reporter: veteran's affair secretary eric shinseki apologized. we were there as he received

breaking news, b.a.r.t. says it's suspended. we understand it's because of a medical emergency in the west oakland station. b.a.r.t. police confirmed to us one person was located on the tracks beneath a train. now the nature of the incident is unclear but again the headline right now, no b.a.r.t. service between oakland and san francisco. we do have a crew on the way to the scene right now to try to gather more information. when we learn something new we will bring it to you. there are new developments tonight on claims that a security guard attacked a student with cerebral palsy. it's a story we first told you

about last night. mitchell was fired for allegedly hitting 17-year-old francisco martinez. the incident was all caught on surveillance tape. today the story was the talk of oakland high school. in fact, a handful of classmates signed a petition in support of the security guard. they say that the student should not have spit at him. >> a spit in the face was the ultimate disrespect, so he got the ultimate disrespect right back. >> he could have done something else. i could see if it was self- defense but it wasn't. >> reporter: the oakland school district says they're not investigating the actions of the second guard now seen on the video. they say it appears she may have been trying to stop the attack but they want to take another look. it has been catching people's eyes for years an art installation that features -- >> but now that building will

hundreds of buy area high school students are being forced to retake their advanced placement exams all because their school failed to follow a key rule. as ktvu's john fowler reports just four inches stand between the students, their scores and their chance to receive college credit. >> reporter: instead of giddiness, a cloud over the class. >> a lot of us are depressed because a lot of seniors are graduating in two weeks. >> reporter: parents are upset too after they learned that a

test taken two weeks ago which their children worked hard will not count. that rule, 5 feet apart. officials found desks used by 400 students were about 4- inches too close. >> ultimately it's the school's responsibility. we take ownership for that because we followed the college board's died lines. >> reporter: the school says this is its first test irregularity in at least 25 years and will offer make up tests but parents are unhappy. >> she prepared last time. she was pretty confident. i don't know how about now? >> reporter: a school district spokesperson told me make up tests will be offered next week. she emphasized there was no allegation of cheating. john fowler, ktvu channel 2 news. facebook founder mark zuckerberg and his wife cristina chen are making a huge donation to help under
