caught on camera. watch what happens here a student smacked by a security guard and tossed from his wheelchair. >> i hit the floor with my chin first. i have a scar right here. good evening i'm frank somerville. >> and i'm julie haener. the family of a high school student is demanding justice as they accuse a school security guard of beating the sophomore at the special needs high school. it's a story we broke at 5:00.

now jana katsuyama joins us with an interview with that student and an eyewitness. >> reporter: he says that he had to come back to the hospital after he was feeling more pain after the attack. along the way you see the guard's right hand smack the student. seconds later he hits him again. martinez is thrown out of his wheelchair on to the floor. >> reporter: martinez gave us his account today as he left children's hospital after he left to get another check up for his injury. >> he slapped me. he slapped me so hard that i fell off my chair. i had a scar right here. >> reporter: martinez says he had protested when the security guard tried to clear the hall and wheel him to class. he says the guard handcuffed him and he admits spitting on

the guard in protest. but martinez says what was not caught on the tape was the guard beating him and throwing him to the ground after an elevator ride that was off camera. martinez who has cerebral palsy says when he told the guard he was in pain he cursed at him. >> he said i don't [ bleep ], he said i hope you don't walk in two or three weeks. >> he said that? >> yes. >> reporter: his mother speaks off camera says he wants justice for his son. she says she took pictures of his neck, chest and hands and says she doesn't want this to happen to anyone elses child. the district immediately fired

marshell mitchell had been hired as a substitute security officer in november who then passed a background check. >> basically snapping and punching the students several times. throwing hill out of the wheelchair or dumping him out of the wheelchair on to the floor -- throwing him out of the wheelchair. >> i'm trying to do the right thing and just have justice for everybody. >> reporter: francisco says he wants the district to take some sort of action against the second security guard seen in that video. we are checking into that. and he says that he just wants justice. mitchell is expected to appear in court on june 16th. reporting live in oakland, jana katsuyama, ktvu channel 2 news. our coverage continues at ktvu.com. we've posted that surveillance video in its entirety as well as the letter sent home to parents by the district.

$2 billion that is the reported sale price for the los angeles clippers. former microsoft ceo steve balmer has apparently won the bidding war for the clippers. he made the deal with shelley sterling. she's the co-owner of the team along with her husband donald sterling. the nba demanded he sell the clippers after his recorded racial remarks went public. the deal still had to be approved bid the league and sterling himself. $2billion would be a record to an nba team. compare that to what sterling paid for the team. he bought them in 1981 for 12- 1/2 million dollars. san francisco is making a new pitch to have film maker george lucas build his museum in the city. major ed lee is proposing to put the museum on cross pier 20 and 22. chicago is also in the running for the museum. lucas wanted to build it in the

presidio but was turned down. he wants it to save all of his memorabilia and art. and organizers promised this year will be different. and learned people attending the festival will notice a lot of changes. the first act will take the stage tomorrow, ken pritchett has more. >> reporter: behind the fence you can see one of four stages here at bottle rock 2014. they were busy setting up today. last year's event was a success in terms of music and performances but it was a big money loser that created bad traffic in the neighborhoods and ill will among some neighbors. this year there's new management with promises of a better experience. it's the same stage from last year but improved. it's the same location but with more places to buy food and

wine. much has changed including ownership for the event. >> i just attended last year and it's one of the best experiences i had in napa and i didn't want it to go away. >> reporter: a new promoter of bottle rock replacing last year's promoter who went bankrupt. after making $11 million on a $20 million event. the city and vendors went up paid until graham's company bought the rights. >> it was one of the promises we made to the city of napa and to the expo that if they allowed us to become the promoters we would make this festival happen in 2014 that we would eliminate debt and we would keep this festival unique to napa. >> reporter: there are nebraskas nebraska -- there are neighbors who would like to see bottle cap go away. neighbors hamerly and camper live just to the side of the main stage. they think -- >> i like it. i think it's a good thing. >> reporter: the event

this morning. news chopper 2 captured these pictures just after a box truck crashed into a guardrail at the end of a connector ramp from highway 92 to 280. fortunately no one was hurt. the box truck hit the guardrail then flipped on to its side. and that forced them to close the ramp for several hours. we have new information on a major east bay drug raid we told you about last night. today six of the nine people arrested face charges in federal court in oakland. the charges against them include the manufacturer and distribution of a controlled substance. authorities say the group was making drugs including oxicodone, zanax and steroids. some are also facing money laundering charges. coming together to heat. today hundreds of people gather to pay their respects to one of their stabbing victims in last week's rampage in isle of

vista. the candlelight vigil for chen was held at his alma mater leland high school. azmith smith spoke to his parents and joins us now from san jose. >> reporter: prior to this tragedy, chen's parents said they were supposed to pick him up in two weeks for his summer break. now they're trying to plan his funeral. a somber crowd filled chen's high school along with chen's grieving parents. >> reporter: the uc santa barbara computer engineering future as bright as his smile taken too soon. chen one of elliot rogers' first women stabbed to death. chen's parents said he lived on campus and was visiting his friend huong and wen simply at

the wrong place at the wrong time. >> it could have happened to any of us. unfortunately it happened to chen. >> reporter: hundreds of his former teachers, classmates and family remembering him. >> there's not a mean bone in his body. this vigil tonight is proof of the kindness he showed us. >> reporter: surrounded by paper cranes the symbol of hope and peace this community trying to heal. his mother finding solice his son in his 19 years was light in so many lives. although she says she wishes this pain on no one. >> i don't want to stand here. if my son could come back i don't need to stand here. >> reporter: chen's parents say they forgive elliot roger who took their son's life and they pray for his family.

as for funeral arrangements they're still working on that but plan to bury limb here in san jose. >> the parents of the killer elliot roger have broken their silence issuing a statement through a family friend. peter and chen roger say the feeling of knowing it was our son's actions that caused this tragedy can only be described as hell on earth. the roger's said they were on their way to their 22-year-old son last friday night when they heard about the shooting spree. they said that's when their worse fears came true. elliot roger killed six young people including three from the bay area. 13 others were wounded. rapper snoop dogg was in san francisco to talk about ending gun violence. in san francisco he was joined by some noted sports and music figures along with local leaders for his campaign called no guns allowed. snoop dogg, said the mass

two winners in the 87 annual scripps national spelling bee. the winners a 13-year-old and 14-year-old both boys. they were declared co- champions. this is only the fourth tie in the history of the competition. and the girl you're looking at is our local california girl. attorneys made their opening statements in the trial of stow. stow suffered severe brain damage when two fans beat him up in the parking lot of dodger stadium three years ago. he was at court yesterday but he was not there today.

stow is asking for millions of the dollars in damages for medical care. the words between stow and his friends and the two men convicted actually started in the stands. >> this is not something is that happened in the parking lot, oh my gosh. this is something that went on for three hours with security doing nothing about it. >> reporter: the dodgers argue there was enough security and they blame the two men who were accused in the beating. they also argued that stow was intoxicate at the time. the flames have charred nearly 700 acres in mariposa county. calfire now says the fire is now 80% contained. two unoccupied homes were

destroyed. and firefighters battled a fire near the seventh street exit. news chopper 2 captured these pictures. that caused traffic delays in the area but the fire crews quickly worked to knock it down. news chopper 2 had already been to this brush fire in the southern part of the city. officials say the fire at kitchner circle started along a creek bed. it too was also quickly put out. high temperatures today got into the mid- to high 80s. tomorrow it'll be noticeably cooler. you will notice five to 10 degrees cooler on your friday than you had today. out in antioch instead of 86 you're going to be about 82- degree. some areas around the bay like oakland could drop a good 10 degrees. the fog and low clouds are working their way back to the coast. you see this patch of fog. the computer model wants to put

new information tonight on the shooting death of a man from fairfield that we first told you about earlier this week. vallejo police have identified the victim as torrance daron lendo. he was rushed to the hospital where he died later. it's the kind of squaller that's hard to imagine. a woman found to be breeding hundreds of rats in a very small apartment. animal control officers are all too familiar with the pest problem and the woman behind it. >> reporter: filth and squaller and hundreds of rats in an apartment. >> it was shocking, disturbing in a number of levels. >> reporter: animal control officials say a woman known as erica jay bred hundreds of rats in this room many that you can

of erica jay's domesticated rats. sick ones have been euthanized. and some evictions narrowly passed a state senate. it had failed earlier today. then the author state senator make leno agreed to make some changes to differentiate between personal owners and realtor companies. students at schools in high poverty areas received far less learning time than students in affluent schools. it sites problems like lack of

teachers and incomplete class schedules at the start of the school year. the use of institutes to fill long term vacancies and school lock downs that halt classes. >> we're asking for the state to start tracking the actual amount of learning time that takes place in schoolsful right now all the state does is look at whether the bells are ringing at 8:00 to 3:00 and assuming that learning is taking place. >> reporter: the lawsuit includes 8,000 students including those from fremont and oakland and nestrom elementary. the school department has lost even more police officers making it more difficult to fight crime. four officers turned in their resignations this week because of changes in the work policy. it's unclear if they would be protected from lay offs. >> there's no safety net if i were to be injured on the job, i would not be guaranteed

disability retirement where i would be able to support my family. >> major chuck reed says injured officers would get their same pay. he says that the new policy was adopted to prevent abuse of the system. the oakland police department is often under fire from people who think the police aren't doing enough to fight crime. but today officers were thanked by one community for the cases they have solved. ktvu's paul chambers was there as the neighborhood showed its appreciate. >> it was this community's way of saying thank you to those who protect and serve. a cook out for oakland police officers because investigators have made arrests in numerous homicide cases including this woman's brother. >> i was with my brother probably 20 minutes before he got killed. >> reporter: des era e velasquez is here to support. >> my brother was a victim, i'm a victim because it happened.

and he has family. >> reporter: in all there's been five killings about a mile and a half from bella vista park. 24-year-old ro nco was shot and killed two blocks from the hospital where he was born. 23-year-old kimberly robertson was found beaten to death on park boulevard. oakland police arrested this man and charged him with robertson's murder. although police made the arrest they can't do it on their own. >> residents know what's going on in the neighborhood. they know what's not supposed to be going on in the neighborhood. when they come forward we can solve all of the crimes. a baby who was born to a

the glass actually like a spider web just immediately lit up. shattered, completely shattered. >> reporter: that's not what you want to see when you're inside a glass observation box 1,300 feet above the ground. a california family experienced that sky high scare during a visit to chicago. they were on the observation deck inside willis tower when the protective coating on the glass shattered. alejandro derbez says he, his brother and two cousins were taking pictures and when they stood up they got the scare of a lifetime. >> we heard it, we see it, we feel it and we said whoa we just jumped off. >> the shattered coating has since before repaired. the engineer said there was never any danger. the glass that broke was only the protective layer that protects the glass of that

floor. measles cases have hit an all time high. there's been 238 cases reported since may 31st. that is the most cases of measles in the u.s. during the first five months of the year since 1994. nearly all of the cases have been associated with international travel by people who haven't been vaccinated. here are the numbers from the department of health from last week. they say there have been 60 cases so far this year compared to only six at this time last year. as for bay area counties, alameda, contra costa and san mateo county each has four cases. the food and drug administration has reported injuries from tanning beds. tanning beds and tanning booths

new at 10:00, buses with a leg up on traffic lights. there's new technology that's keeping the lights green longer if a bus is approaching. the idea here is to keep buses moving through some of the san francisco's busiest corridors. >> cara liu has the story on a program that's about to expand. >> reporter: it's no easy task

getting through san francisco in busy traffic. but that's changed now that a system has sped up commute times since it was activated in mid-march. >> we're seeing significant changes, on average five to seven minutes on a tr -- trip that could be 50 to 55 minutes. >> reporter: frequent munni rider michelle horton says she's noticed a difference. >> they do move around a lot faster than they used to. >> reporter: the technology involves an antenna on the bus that signals an antenna on the traffic light that monitoring the system. >> we're trying to improve travel time onlines that impact the most riders. >> reporter: installations are in progress on the ajuda line and is slated to be installed by fall. in total about 125,000 riders

the models are 2008 to 2011. a smaller recall of 108,000 are for fort explorers. you can find more information on our website ktvu.com just look under web links. southwest airlines is being fined for violating rules when it comes to advertising. transportation fishes fined southwest $200,000 for tv ads that aired in atlanta. they say they promoted $200 fares but an invest found there were no seats available for that advertised flights. southwest issued a statement saying it was a mistake and the ads were pulled. a victory today for california workers earning minimum wage. the state senate approved a measure that would gradually raise the state minimum wage from the $8 an hour to $13 in 2017. last year lawmakers approved a bill that would raise the minimum wage from $8 to $9 on

july 1st. then increased it again to $10 in 2016. republicans say the increase will force businesses to raise prices or fire workers senator mark leno says his bill will help lift many of the 7.9 million minimum wage earners in california out of poverty. a measure requiring employers give workers at least three paid sick days a year also cleared major hurdle today passing the assembly. the bill would allow employees to accrue one hour of paid sick leave for every 30 hours worked. employers could limit that paid leave to three days per year. the california chamber of commerce has branded the bill a job killer. if signed into law the measure would go into efect in july 2015. temperatures on their -- would go into effect in july 2015.

which is more aggressive than we've seen in a while. that means that's going to start the cooling obviously. look how far inland. napa. out in the livermore valley out toward antioch burns back to the coast. but then tomorrow afternoon it comes back. so that's the game it's going to do that thing it does typically this time of year what goes inland comes back to the coast but it's going to be with us the next four or five days. that's why temperatures are trending down. 82 in clear lake. another warm spot away from the sea breeze. 67 in oakland, not cold but certainly cooler than it has been. kind of a warm week after monday got over. and temperatures will be 77 in santa clara. 77 in san jose. along the coast fog back in the forecasts so mid-60s. the bay area forecast with the bay area weekend always in view. slightly cooler tomorrow. more cooling on saturday. sunday will be your warmest day on the bay area weekend with temperatures getting back into the low 80s.
