old boy suspicious. exactly how and when that toddler died is still amidst early. but police have taken several people into custody. we get more now on this developing news, can, tv is on the boulevard where the child's body was found. reporter: the child's mother found him this morning, she tried to get help but it was too late. authorities are questioning several people trying to get answers about what happened here. one by one police brought them out. a total of four people handcuffed and questioned about what happened inside this oakland apartment. >> the police come and the baby go out the door. that's all. reporter: the child, a by about two years old, neighbors say when the mother found him this morning he wasn't breathing. >> he woke up, looked and the baby was gone. reporter: police are calling it a suspicious death and homicide officers are

miles away when the accident happened. cruz of pittsburgh was killed on highway 24 on lafayette. driving east in the westbound lane and hit cxconf[ head-on. the husband and father of two was killed instantly. mckay's blood alcohol was twice the legal limit. she is serving a six year prison term. eric clayton dresser of danville is under arrest, dresser gave mckay alcohol before that deadly crash, she was under age at the time. a oklahoma police officer is up a probe following investigations that he is working as an fbi agent in boston, he is collecting disability from the city of oakland. technically the agent is not breaking any laws. reporter: former oakland police officer erin mcfar land gets $52,000 a year collecting disability checks from the city

as santa clara judge ruled today, christopher hubbard will be released in palmdale on july 7 july 7th. he has been in a state hospital since 1996. women came to san jose to speak against his release. hubbard has been in and out of custody for sexual assaults since the 1970s and the women fear he will strike again. the man accused of killing morgan hill teen was in court today for the first time since prosecutors say they announced they will seek the death penalty. unsealing documents, supporters of the lamar family hope the threat of a death sentence will convince to tell the authorities where to find sierra's body. a woman has filed a lawsuit against the in and out burger chain after hot coffee spilled on her lap. she was handed a cup of coffee
