a no contest plea in the south bay courtroom. he faces felony charges including weapons possession and dui. tonight there is still a chance he may spend time behind bars. and our top story at 7:00 p.m. we explain the pe and what comes next. >> 49ers linebacker aldon smith was kept out of sight for hours before he walked into the san jose courtroom before sitting down in the gallery and taking a seat. smith is facing three felony weapons charges and three misdemeanor charges related to dui. he originally pleaded not guilty last year, but today changed to no contest. as ktvu reported smith's felony charges related to a party at his home in june, 2012 or shots were fired and a subsequent investigation turned up an assault weapon. misdemeanor dui charges came after smith crashed his truck into a tree and driving into a home turning up the backyard.

it's time he was charged with possession of marijuana, that charge was dropped. today the prosecutor said the das office does not make a plea deal but instead smith decided to take his chances with the judge. >> that's the difference between a plea bargain were you see charges dropped or plea sends. >> legal analyst says smith will have to prove to the judge why the felony should be changed to misdemeanor. >> is he changing, is the community work that he is done, the fact he perches these weapons legally in another state. >> he's not a thug, i don't think he is out of control are making bad decisions. certainly he has made mistakes. who hasn't. >> smith faces up to four years four months behind bars and is scheduled to return courtjuly 25 . a short time ago 49ers general manager trent baalke released a statement it reads, we are where the aldon entered a plea today in the case that we have closely monitored. today was an important step of bring

that situation to resolution. less than an hour from now friends, relatives and classmates will gather to remember high school senior who was killed in an accident on the tracks in san leandro. investigators say 18-year-old brittney so was crossing the railroad tracks with your earbuds in and didn't hear the oncoming amtrak train. this happened monday night, tonight's memorial will be held at san leandro high school at 8:00 p.m. a group of teenagers want to create a memorial for their alhambra high school classmate. the 14-year-old from martinez was killed by train in march. it includes a climbing structure, climbing area and barbecue neighborhood where jenna lives. city officials like the idea but homeowners association owns the land turn them down. >> i think their mindset right now is that we are not taking it seriously, were just couple of high school kids doing a project i think we need show them we are committed to doing this. >> the students tell us if they get the project approved

forklift crane. >> we don't have a lot of other information other than that. in fact i don't know who the employer is. >> investigators say the man fell from a height of about three stories. now they're working to determine what if any safe measures were in place. >> were talking about multiple stories, there should be fall protection for employees. >> cal osha spokesman peter milne says construction work is inherently dangerous. even a shortfall can be deadly, which was the case yesterday in san mateo. investigators now say 54-year- old allies barrel landed headfirst from a 9-foot fall, not 15 feet as initially reported. >> we treat every accident has its own accident, we go there, we interview people, we look at what happened, we and review the employers injury and illness prevention program. >> meanwhile at the san jose accident site the developer declined comment. on the company's website it shows the project will include 94 townhomes which price in the

a south bay judge is deciding when and where a notorious rapist should be wiest. christopher hubbard is known as the pillowcase rape her. he left the stream of victims between northern and southern california, california. >> they call themselves the ladies of lake los angeles. they traveled seven hours to san jose to ask a judge to stop a sexual predator from moving in for decades. christopher hubbard also known as the pillowcase rapist terrorized women from the bay area to southern california. he got his name because he put pillowcases over his victims heads to muffle their screams. hubbard admitted to 38 rapes over three decades. authorities believe the actual number of victims could top 100. >> we don't want him out, not where we live not were anyone else lives. >> last year san jose judge says hubbard could be released

. a win with wildfire in arizona more than quadrupled in size today as fire fighters headed to the fire line. it's burning in a canyon between flagstaff and sedona near the popular flag rock state park. homes, businesses resorts and campgrounds have all been evacuated. authority say the fire has grown to 4500 acres with zero containment. the fire began about 4:00 p.m. yesterday. the controversial, hazardous landfill. california hazardous waste officials gave the go-ahead for the site to grow by 50%. it's located in kings county along interstate five and it's the largest toxic way site in the west. elements of the sun increase in birth defects several years ago but public health officials say there was no connection to the landfill. a warning tonight for animal owners. bay area veterinarians tell ktvu there's been a recent surge in dog poisonings and death, all from eating snail bait.
