>> martha: thank you very much john and sandra pack a beautiful day here in lower manhattan. good afternoon everyone in martha maccallum. today the story is live outside the manhattan courthouse where former president trump is standing trial in the stormy daniels case. i was inside throughout this morning's proceedings and i will tell you a bit about what we heard in their. part of the business from this morning was the judge hearing the latest on the remaining gag order violations he is considering and later we heard some pretty hellacious back-and-forth questioning peer heated moments were interesting, it became an interested -- interesting witness in keith davidson. he brokered the deals for stormy daniels and karen mcdougall but he really got his feet help to the fire by both sides. so, also today on the other big story we've followed all week for you, today we heard from the former and current president. they addressed the chaos unfolding in the early morning

hours at ucla and across the country. watch this... islamiphobia or discrimination against arab americans or palestinian americans. >> martha: breaking news this hour but first to nate foy right next to me here outside the courthouse where there u.s. president joe biden: is a small group of loud protesters, a tiny group but they are making some noise out there nate. >> reporter: >> they are making some noise martha as we are now and a five minute break. the cross-examination of the la-based lawyer keith debited -- davidson is over. after this break prosecutors will have another opportunity to ask him questions but before this break trump's team presented recorded phone calls between davidson and michael cohen where they discussed the possibility of stormy daniels having "settlers remorse" and in another call davidson said if they don't make a deal and trump loses the election, they would lose leverage. davidson also answered questions about a post about stormy daniels and

president trump from 2011. he had the post taken down five years later he negotiated a 130,000-dollar payment from michael cohen to suppress the same story. davidson did not connect any of the deals directly to trump he said cohen told him "f it i will do it myself. he also signed a confidential -- confidentially -- confidentiality agreement. he appeared suicidal after not getting a position in trump's white house after the election. lawyers asked them for the definition of extortion and question him about deals he made with celebrities like lindsay lohan, hulk hogan and charlie sheen. trump is also responding this afternoon to reports he appeared tired while listening to today's testimony, posting on true social "contrary to the fake news media i don't fall asleep during cricket da's witchhunt, especially not today. i simply closed my beautiful

issue kaylee. it was an interesting moment in court when keith davidson talked about an exchange he had with michael cohen. in december before the president took office khaki learned he was not going to be as he thought he might be either chief of staff are potentially attorney general and he called keith davidson who is out christmas shopping at a big box store and, you know, kept him on the phone for hours just ranting about this. and he said can you believe i'm not going to washington after everything i've done for him i can't believe i'm not going to washington, i saved his you know what. kaylee i just wanted you're thoughts on this because does this go to motive in terms of michael cohen and how he handled all of this? and his own wanting 2.2 figure elsewhere because we heard a lot today about this not touching trump's hands and that's what davidson testified today it.

>> it is one of the most biggest and interesting takeaways from keith davidson in addition to the defence laying out a pattern of extortion if he will he calls them settlements. but learning about this exchange with michael cohen is big. we know he has a history of lying and this is the witness on which the prosecution hangs the entire case and now we learn about michael cohen perhaps a motive and not being taken to washington than coming out with all of this salacious information. when you add that this is not information the jury heard but just for viewers to hear, the earlier conversation about the gag order where it said michael cohen is out there making money on tick-tock floating a tv show these are the allegations of the defence. it paints the picture of a witness that is questionable to say the least and this is the witness on which the entire case rests. >> yeah, and they really work to try davidson -- tied him to

davidson and take both off the table together. we'll see if they did that satisfactorily. i want you're thoughts of this campus chaos we are seeing as well in terms of what the impact is on the 2024 election. i thought it was interesting because joe scarborough this morning on his show in the morning basically said it took him back to the law & order campaign of richard nixon in 1968 and he said this is what turned his family who were southern democrats to become republicans which swept that whole region during that period. here is what he said... >> the riots on college campuses and at the chicago convention and 68, all of those things moved my family from being democrats their entire life to being republicans. if you are offended by this please i'm trying to help you. i don't want almost trump to get

elected. >> what is you're take on that kaylee. >> it's a rare thoughtful point from joe scarborough khaki is right i don't often say that but he is right. at alonso the piece that came out yesterday where all these democrats were saying its a big political moment. one democrat was asked does it give you political heartburn to which he said how could it not? i believe those tailwinds, these political tailwinds are what drove the president to speak out today. i don't want to overstate this at the goods a huge moment back i personally hear suburban moms talking but it, maybe not people talking about politics, it's about to be summer and this could go away but i don't think goes away. the images you're seeing now on your screen are going to replay at the democratic national convention so this will continue and difficult into the fall and we see this again it absolutely could be a wedge issue on which the election turns. >> martha: and there is a lot

seems to be speaking most loudly and another sign says convicted trump already. so you've really got all signs -- all sides represented. but i couldn't believe the video when i saw both sides yelling expletive biden at each other. what is you're take away leslie? >> there are a few takeaways, i don't like what they are chanting just shows two sides that are different can come together and agree on something. and also what i find a couple thanks fact i live in southern california and choked by ucla yesterday i wanted to see what by own eyes and sea for myself, i saw her a anti-semitism and anti- muslim message is just disgusting here at the ucla campus in california where i live in the united states that we have such hatred toward people in both these religious groups with what i saw from my

protest is ridiculous. these people are hateful, they are hard asking jewish students, they are shutting down campuses and preventing people from graduating and preventing jewish students from accessing education they paid for. they are yelling at them go back to poland. can you imagine if their people sank back to africa to black students? on these campuses. the problem on these campuses leslie is not at this -- islamiphobia it is an anti-semitism problem. everything else went into one or two sides is just a distraction. >> martha: a couple of thanks. >> a couple of things, that is not the majority sorry. it's the majority of the protest certainly that's not the majority of the protesters on any of these campuses. and by the way there are numerous jews that are also pro- palestinian or supporting pro- palestinian movement, you know,

they want to cease-fire in gaza i think it's extremely disingenuous to say every single jewish person who is pro- palestinian is anti-semitic. >> we certainly see divisions within israel and within jewish people here in terms of what they support. at thank most sane people can say we need to have peaceful situations in terms of these protests but, you know, one of the things i think that will get a lot of attention here is the question of law and order. we keep thinking back to 1968 when nixon won on a law and order platform really when there was so much to mould and protesting going on in the country. here's president trump shaking hands with law enforcement yesterday. take a look at this. alright so you see the former president shaking hands and

talking to people, clearly he sees this not only is something he has always done, i don't think it's disingenuous but it's an important message for his campaign given what's going on. >> i mean think about this, if you look at the 2020 election, the vast majority of americans said before the election they were better off now than four years ago under trump than they were before he took office. a lot of people didn't vote for him because they were tired of the chaos. here's the question, argue, is the cows work -- worse or better than it was four years ago? there is chaos on the campuses and on our borders and in the middle east, there is chaos in europe. biden has unleashed worse chaos then anything trump had ever done. trump will we'll be actually running for the candidate to return back to normalcy which is quite ironic. if you think about it so the chaos is hurting joe biden without a doubt and it's everywhere. >> what a crazy world we live and i'm thinking about what

for. they were related to comments the former president made about the jury being mostly democrats and david packer saying he was a nice guy and michael cohen in terms of their back-and-forth, they used to be very close but not so much anymore as you well know. we will wait for the decision from the judge on those. andy mccarthy's standing by. let's bring in jesse pinnell first an attorney for tran net -- former president donald trump not representing him in this criminal case. jesse great to have you. if you could speak to what the trump team back the defence side was trying to establish today in terms of the fact one of the witnesses who was the attorney stormy daniels and karen mcdougall basically said in all of his dealings with michael cohen it was really michael cohen he was always dealing with and that he said he was going to do with that on his own and use

his own money to take care of this situation. what does that tell you and how do you thank the jury will take it in? >> thank you martha. let me say it was vary and lightening some of the testimony today because what it really showed was that michael cohen was driving this boss all along. in fact he was the one that was making the deals, as you said he was talking about paying it out of his own money. then later he also testified michael cohen was upset he didn't get the job he wanted in washington dc. he was going to be brought into a high position in the administration. what we see time and time again here is the real defendant, the person the prosecutors should really be going after here is not donald trump packets michael cohen. >> martha: you know, you get in there and you listen to all

of this as i did today, jesse you are talking about extortion plots from this attorney and whether or not he is an extortionist, and all of this, it is a lot of groundwork but the jury is this knew to all of this. i don't know what's going on in their minds, it's always a big question when you watch this play out but we haven't really gotten to the crux of how that relates to this state felony that they claim is an election interference charge. >> that's absolutely right because what they have right now on the witness stand someone who's being investigated for extortion before, someone who has really the trump lawyers today were showing how this was an extortion attempt against president trump all along but what the prosecution cannot do and all of this even if they get these witnesses to testify to everything they want them to testify to his connected to any

crime. connect it to any campaign finance act violation because time and again the experts in campaign finance law for instance former commissioners at the federal commission have explained that this is not a violation of campaign finance law. it something a nondisclosure agreement is not something prohibited by the federal election campaign act. so, this is probably why alvin bragg's office has been so slow to try to show what their actual theory, legal theory of the case is. because they don't really have a legal theory of the case that can withstand or muster especially on a pallet review. what they have is an ability to try to take donald trump off the campaign trail and try to embarrass and nationally which is exactly what this case is about. this case is about trying to sideline donald trump in the presidential election for is not

on and what did you think of this morning? what were the highlights to you? >> i thank the new witness martha is probably part of the tedious part of the trial where they have to lay the foundation for other evidence they will put in. if he is a digital expert he is probably explaining to the jury why a recording is authentic which is important in terms of the integrity of the evidence but isn't vary riveting riveting. as far as the testimony we are seeing, i really think the trump team has been induced by bad rulings from the judge to do this but their defence doesn't make any sense to me because if you want to make a big deal about the fact michael cohen was driving this train, that sounds like what he was doing was really bad and that's not consistent with saying nondisclosure agreements are completely legal. so if your position is

nondisclosure agreements are completely legal as i said the peas are rogue earlier today i think i would be sitting there doing the crossword puzzle not acting like i was being hurt by the testimony of his lawyer for stormy daniels. if it is legal then why paint cohen as a fuse doing something terrible? >> martha: you make a great point andy as always. you could be examining this witness and sang than you did this, thing you did that then you did this all of which under new york state law is completely legal and then just sit down and let them go to it. i do want to ask you about this because there is back-and-forth on michael cohen at his post this morning with this issue. obviously former president donald trump wants to be able to say whatever he wants. he feels like everyone else gets to end the judge pointed out he is the one on trial and these other people are not. but michael cohen has been so

aggressive and what he is posted here that a lot of folks including our legal analyst said there is no reason not to gag michael cohen. but a couple of these posts up, it is a repost which we know the former president got in trouble for doing of super victim former president trump in a huge overweight superhero cost jim. and then this one fact the other one, where cohen says keep messing with me donald and i won't send you any money to your commissary. michael cohen with another stick action figure. should these things, i think they may have been taken down, but should they impose a gag order on michael cohen even though he said he put one on himself at this point quick. >> i don't think there should be any gag orders frankly but if you're going to have them, i think what you're seeing from judge marchand is virtually every important thing he gets it wrong. so the answer here is not that

michael cohen is not on trial and trump is, the judge's job is to protect the defendant, the other people, you know, but if merchant is saying i need these gag orders in order to protect the jury from prejudicial outside publicity then what difference doesn't make of it is donald trump talking about the case or cohen or any other participant in it? and obviously the prosecutors have a lot of influence over michael cohen you think they could stop them from doing these posts in a heartbeat but obviously they decided not to do that. >> i think you make such a good point i hope people pay close attention to it with regard to the defence and the approach and if their line of thinking is that there is nothing illegal that happened here, that line needs to be drawn clearly for the jury for them to be successful in that. obviously we have sirens going on in the new york police department is so busy these days

>> martha: wow. that is quite a seen. former new york republican governor george pataki standing buy but first alexis mcadams who knows the story very well she was at columbia for days and now at nyu with the latest on the protest there. hello alexis. >> reporter: hello martha we are right in front of the nyu building they just had maintenance workers cleaning up at red paint for short time ago that someone sprayed on the wall during those overnight protests. this is the gaza solidarity encampment here. the students or tried to block the area with signs. also they put up their umbrellas because they want to hide the gaza solidarity encampment. another thing they want to hide their faces. i asked one of student last night why and another woman why she was wearing a mask and she said it was for covid-19.

that is that the latest from here at nyu. we will keep you posted on the protest martha. >> martha: thank you so much alexis mcadams. let's bring in former new york publican governor george pataki who joins us now. always good to sea you. we haven't heard from you since all of this started happening in new york. when you look at the scenes inside hamilton hall at columbia university. let's pop up this picture of -- for the governor on the outside of the tent it says crush one campus another rises. what is you're take on this governor? >> like a mother this is just disgusting. it shouldn't be tolerated. these are not acts of free speech or protest, these are acts of anarchy. they should have been stopped on day one. university administrators should have stopped it but they didn't. when they didn't do it, since they are clearly raking the law, the nypd in new york and others across the country should have been called in right away.

in 1968, the last time columbia had rights like that, i was there and was vary active leading some of the anti- protesters. the longer it goes, the more propensity for violence there is. it should have been shut down day one but it wasn't. i hope it is shutdown across the country right now. >> martha: mayor adams also said there should be no tolerance for this and here he is speaking out about the flags. we've seen palestinian flags rising in different areas on some of these campuses. i want to play what he said and then control room if you could play after that the video we have of the nypd putting the american flight back up at city college. watch this if you would, governor. >> it's despicable that schools would allow another countries like to fly in our country. so, blame me for being proud for being an american.

>> [ chanting ] >> martha: incredible. ucla professors saying protesters assaulted them. we have one we will speak with and a moment. verse two christina pullman hello christina. >> by martha. very intense moments we aired. you can see in this area it looks dramatically different than it did hours ago when the area was covered with pro- palestinian protesters. you could see this massive clean up effort going on. tens of thousands of debris being moved from this area.

there were hundreds of tents here and as you can see they are gone. it's been cleared out but go ahead and take a look at the video from early this morning. the ucla police using loudspeakers asking protesters to clear the area immediately noting those who didn't would be subject to arrest. 1500 students around the perimeter of their makeshift barricades. this whole area was covered with plywood, trash cans, whatever they could to cobble together this little compound they had set up for their anti- israel protest. but law enforcement were not having it last night. they launched flares. some used flash bang type devices and moved out protesters. officers wearing swat gear swept in and methodically dismantle the barricades. they moved in on these protesters and clear them out. there were scuffles here and there but again as you can see those protesters were gone. more than 200 were arrested.

for a specific cause, these people were not to mistreating for a specific cause, they were anarchists. they were not in the compound, they would leave the compound, harass, attack students pack faculty and anybody that didn't want to align with their view. i was walking giving an interview and walking in the direction of that compound when a couple of big guys did in front of me and block my way when i try to walk around them and another person tackled me from the side. my earpiece flew out. then they stole it and ran away. you asked what we're going to do about it, hope it remains peaceful. >> martha: yes. >> you know, that's not up to me or you. the police are the only people that can make law and order in ucla and the police need to have a directive from the civilian government, the chancellor, vice

chancellors and regent. we have to ask them if they're going to keep law and order peace so we can have a university again where we teach and learn, or will it be the wild west? >> martha: at let me ask you personally having spent decades at ucla how do you feel about this moment? dew you think it is just a moment or do you think that the culture is changing and it can go back? >> this is not just the moment okay? i teach in the medical school and i teach medical students and residents. there has been an anti-semitic course and curriculum in the school for several years now. almost two years ago this was brought up to the dean and a letter was written and signed by multiple faculty. to this day they are still teaching that course. it's a course that brought in a

previously un- incarcerated homeless activist is tell students to pray to mama earth. a course that tried to divide students into race groups. of course that is teaching that use our white colonialists. this is happening today. >> martha: it's a horrible reality that we are living in. it's difficult to figure out how we get from here to there. this is a quick shot of portland's -- important state university. you see people running at the police officers. watch this video for a second. >> you are under arrest. stop! >> martha: the peace in the wall street journal today

professor that basically says this is not necessarily about what's happening in the middle east and that it is sort of an engine suit problem in the country with the culture in the country. dew you agree with that? >> well i can tell you that many of my colleagues have ventured near the camp and asked simple questions to these protesters about the issues they are processing. the vast majority of them don't know and are not even embarrassed of the fact they don't know they basically say ask one of the people wearing a green vest they will oscar for -- answer for us. it reminds you almost of a cult where there is a leader then the blind followers. i don't know how we got here but i think we really need to investigate the money trail and whether there are outside countries and groups that are trying to influence our youth. >> martha: thank you so much is good to have you with us'
