the, the, this is dw news live from berlin. the guilty verdicts against him helped ignite the meet to movement. now one of harvey weinstein is convictions has been overturn new york's highest court cautious of 2026 crimes convention, conviction against the disgrace hollywood producer. that doesn't mean weinstein will walk free, also coming up. supporters of donald trump face off with his critics outside of the us supreme court. inside justices consider a historic case. should the president be immune from prosecution for a legend, primes committed while in office? and then is introduced as an entry fee in an attempt to curve mass tourism and protect residents.

the i'm in ease of welcome to the program. we started in the us where new york's highest court has overturned a 2020 verdict that found harvey weinstein guilty of rape. the new york court of appeals ruled that the former movie director and producer, was not given. a fair trial accusations made against weinstein, were the spark behind the global me to movement, which saw women around the world, sharing their stories about sexual harassment and abuse. rumors of harvey weinstein sexual misconduct had been circulating for years, but is 2026 crimes conviction in new york state confirmed it. the judges has now overturn that in order to new trial. in a 43 decision new york's highest court said the judge in the original trial, a lot of cross examination that portrayed the powerful producer and
1:02 am
a negative light. the judge also allowed testimony from women who claimed weinstein had assaulted them, but were not part of the case. the 2020 guilty verdict along with newspaper articles in statements from well known actresses lead to weinsteins downfall. some of whom are dismayed by the latest ruling. this today is an active institutional, the trail and our institutions betray survivors of male sexual violence. and we need to work within and without the systems to start having what is known as institutional courage. none of this means weinstein will be freed. he is in prison in new york and was separately sentenced to 16 years for another rate in los angeles. the new decision is still a disappointment for some women. uh well, i saw it about an hour ago and headlines and i gotta say it made me sick to my
1:03 am
stomach. i'm a sexual abuse survivor myself. so the idea that this man, this monster is getting another shot. i just. yeah, just as hasn't been serv just this week. i mean it's messed up and it's just what, where america is, i guess unfortunately, but i'm not surprised. and it's subsidized. like the core, the, the campaigners emboldened by harvey wines teams downfall wonder whether use of social progress have also been overturned for more and joined by entertainment journalists, k. g matthews, in los angeles. thanks for being with us. um, could you explain to us what exactly was the reason why wind students conviction was overturn as yeah, it seems very complex, but if it really isn't, the bottom line is the appeals court judge said that the trial judge should not
1:04 am
have allowed all of the evidence to be allowed in the bottom line is he was convicted because certain woman came forward for a specific case in new york, however, that judge allowed other women who also made allegations to come forward and tell their story. the problem with that is that those women had nothing to do with the particular case that he was being tried for. and so now the judge of saying it was unfair and you were allowing in prior bad acts that were unrelated to the current case in which he was being tried for. and so now they're left with deciding should we retry harvey weinstein, which we already know the aid has already said he will do that. okay, so a lot of the public has been taking this as shutting down on whether or not wines dean was guilty in this case, but you're saying that's not what it's really about here. no, no, you should not walk away saying that this judge is saying that harvey weinstein is
1:05 am
not guilty. that's a totally separate entity. this judge is saying is that the trial was not fair to him, but the judge is not saying that he's not guilty. so we have to look at 2 separate things there that there was evidence brought in that should not have been brought in. therefore, i get interrupted his ability to have a fair trial which every individual in america is entitled to. and one's name was accused by dozens of women. this isn't even the only conviction rate conviction that he's faced. he's actually in prison due to another red conviction. so does this ruling have any practical consequences for wanting a yeah, as you just her key was convicted of rape and sexual assault in california to which he was sentenced to 16 years. so he was supposed to serve about that time once he finished his time in the state of new york. however,
1:06 am
now that that case is kind of been tossed aside and he's still in prison in upstate new york. they may end up shipping him over to california to start serving that time until they retry him again in new york. so he's not getting out of prison. he may shift prison, moving from upstate new york to california los angeles, california to be more precise, but he's not getting out of prison any time soon. and what are people saying in hollywood about this ruling? you know, ashley judge, she really is. the woman who came forward with accusations against harvey weinstein back in 2000. and 17 1st. and she was just saying, you know, it's a bad day in america are for women. you know it, she was really, really shocked and say, we're not entitled to our body to which harvey weinstein attorney held her pressure today, basically saying it's a great day in america, that people can now have
1:07 am
a fair trial that he doesn't believe he's above the law but he also doesn't believe that harvey weinstein is beneath the law, so he thinks it is great. moving for an entire was everybody to have a fair trial. but of course, all of the woman that come have come forward in the past and made allegations against harvey weinstein are very disappointed at today's. a lot of people said when these accusations against weinstein came forward. and this was just the tip of the iceberg out there was actually an underlying sex is culture prevailing. and hollywood has this culture changed at all in the years since we've seen these 1st accusations against wednesday, or you know, what's interesting weinstein kicked off the need to move mit. and then after that, you know, you had a lot of people who came forward in hollywood and talked about the sexual harassment sometimes sexual assault, that certain powerful people in hollywood had done to them. you know, you will remember bill cosby and they certainly after that you had a there was
1:08 am
r kelly and and now even recently you're having p d and there's a number of other people and that happened for years and years and years. but it's been all 7 years. so i think what i've seen, that's really changed in hollywood. it's interesting is a lot of companies have put in procedures and practical ways that people who feel they may be uh, being sexually harassed or don't are feel intimidated. can come forward and now speak to h r r. there are, you know, a hot lines and i'm, it's hotlines, they can call, i don't know if it's change all of the culture in hollywood. i think that sexual harassment is pervasive in a lot of different fields in industries. not just hollywood. so you know, we go through ads and flow, so we'll just have to see what happens when he's retried and see all hollywood responds to that. we often talk about wine seen as disgrace to hollywood,
1:09 am
producer. you hear this all the time? disgraced a hollywood mogul. does he still have some supporters? and hollywood as his lawyer is. lawyers are as supporters and you are people in hollywood that still support harvey weinstein. let me tell you, they're keeping their mouth shut. they are not coming forward. they are not speaking out. all you are hearing are people who are against harvey weinstein. and really believe that this many women cannot be line. obviously, there was a problem. and then he should be punished for his actions. anybody that feels differently than that is not coming forward, is not being public about it. uh, at least in hollywood. okay, well, it sounds like we will be hearing more about harvey weinstein in the future uh, kj mathews. thanks for joining us. thank you. well, the us supreme court again hearing arguments in an immunity case brought by

a former president, donald trump. justices are deciding whether she can be prosecuted for conspiring to overturn the results with 2020 presidential election. trump argues for her presence should not be liable for crimes allegedly committed while in office. trump was in court, but not in washington. he's on trial in new york city as well for allegedly paying hush money to cover up an affair. now he complained about not being able to attend the proceedings for the case in washington. our bureau chief in his poll is there and set the scene for us outside the supreme court. just to give you a little bit of an idea of the space, the supreme court is right behind me in the capital is just a couple of 100 yards away. and this is, of course we are a trump supporters. i tried to stop the peaceful transfer of power in january of 6 of 2021 day of feeding cards done by donald trump to do so. and then of course,
1:11 am
it took donald trump a couple of hours before you ask them to stop trying actually to, to the wife present. so this is a very uploaded atmosphere here. there's a lot at stake, and that's what people told us who traveled to you. uh, to washington, to business this historic day. no, i don't know one's above the law in this country. i think there's numerous laws he's broken and i think he needs to pay for him and face the music of unity. immunity charge it should be dropped because there are certain say without uh, just completely wiping other sides or charges that are against him. yes, he should be a knew it was practically the, you know, the assumption growing up in this nation that no one, not even the head of state is above the law. and, you know,
1:12 am
the presidential own is to preserve, protect, and defend the constitution. the law of the land, if the president can break that presidential oath within community, then what are we as a republic? now these are not nearly present in august are not. are you sure? not on unity. that's what it's all about. know about this. i believe that this supreme court just took this case to delay criminal trials for the president start reporting from our washington bureau chief enos paul speaking to us earlier about venice, italy is worth a visit. and 5, yours to italian authorities have introduced a new 5 euro fee for people wanting to visit venice. federal say the new fee is aimed at curbing peak tourism to the fragile lagoon city and safeguarding spaces for residents. they also hope it will help provide more information on the number of day trippers. something that's been relatively unknown,
1:13 am
hits the city of canals, culture, and crowds. venice has long been stream by mass tourism. now a pilot project aims to rein it in. dave visitors have to pay 5 year rose to enter . the officials say it will discourage tours from coming during peak times and make the city more livable for residence. the charge also tells officials how many de troopers are coming in. these tourists are happy to pay a t z. i think we should pay 10 meant 5. we should pay more to help. you've got to it's too crowded. otherwise, if you want to get the most out of it. but not everyone agrees, venetian protestors say the tax won't stop over tourism, as there is no limit on visitor numbers. they argue more needs to be done to support the local community. and that's the size of done because it is the we can
1:14 am
save this just by giving houses to the local residents. and by repopulating it it's only stim date tourism. it does not reduce. the bigger influx is from asia, from china, from america, it will change absolutely. nothing. so what i want to leave my house, i have to pass through 3 or 4 bachelor parties. i called the local police to tell me they're not doing anything wrong, but they get drunk, they come back late, the alleys are full of rubbish. there are no controls. venice is the 1st major city to run such an experiment, one that could become a blueprint for other destinations, plague by over tourism. and you're up to date of next our show planet, a takes a look at whether a new kind of fuel can clean up the shipping industry. there's more news on our
